By downloading or otherwise accessing the App you agree to be bound by the following terms and conditions (“Terms of Use“) and our privacy policy. If you have any queries about the App or these Terms, you can contact us at associatecare@indianmoney.com.
You can use the Lead Market App, to buy leads based on your requirement for the financial products sold by you, at a minimal price. After buying the lead, you will receive all the details of the lead, like its name, address, mobile number, annual income, area of interest, requirement details at your handheld device.
As you agreed to the terms and conditions, while registering the App, so we assume that you will abide them without any discrimination.The terms and conditions listed in the lead market app and www.leadmarket.in shall supersede any written and oral communication by executives or representatives of SHPL or IndianMoney.com or Lead Market in all the circumstances.
After registration, you would need to recharge your Wallet by adding money using the My Wallet feature either using online banking, credit card or debit card to be able to avail the features, that this app is entitled to provide.
The App is made available for your own, personal use. The App must not be used for any commercial purpose whatsoever or for any illegal or unauthorized purpose. When you use the App you must comply with all applicable Indian laws.
You hereby agree not to:
(a) use the App in any unlawful manner or in a manner which promotes or encourages illegal activity including (without limitation to) copyright infringement; or
(b) attempt to gain unauthorized access to App or any networks, servers or computer systems connected to the App; or
(c) modify, adapt, translate or reverse engineer any part of the App or re-format or frame any portion of the pages comprising the App, save to the extent expressly permitted by these terms or by law.
You agree to indemnify Lead Market and its group companies in full and on demand from and against any loss, damage, costs or expenses which they suffer or incur directly or indirectly as a result of your use of the App otherwise than in accordance with these Terms or Applicable Laws.
No claim of charge back / refund shall be admissible under any circumstances as:
1. Money paid to Lead Market will be converted into Lead Market Credit Points (CPs). CPs have to be used exclusively to buy the leads at Lead Market.
2. All Leads available on Lead Market are generated through a standard process which is completely documented.
3. We spend money on promotion & lead generation considering the demand from you. Hence, when you don’t buy the leads displayed in Lead Market, we do incur loss as there is a huge cost to keep leads available all the time. Also, the leads are highly perishable and cant be reused.
4. If there is any fault with any lead bought on Lead Market, you can apply for replacement and the same will be rechecked by our quality team using the documentary evidence available with us like the recording of the coversation happened between our Wealth Doctor and the Consumer (Lead).
5. Replacement requests will be attended as per our Offer document.
6. Incase, if your replacement request is not inline with the terms of our Offer Document, we will reject such requests and can provide the documentary evidence available with us upon written request to associatecare@indianmoney.com along with a declaration to confirm that this proof will be used only for internal use & will not be published anywhere as this leads privacy breach of the consumer.
7. Though there is no validaity for the wallet balance, this will not be refunded under any circumstances and the wallet balance has to be used only to buy leads through Lead Market.
8. You are requested to recharge your Wallet only if you agree & accept all the terms & conditions mentioned here.
9. You are recharging your wallet only to buy the leads available in Lead Market & the company is not responsible for non-availability of leads under any category or in particular place.
10. In order to provide more value for every rupee paid by you, the company provides additional benefit in terms of extra credit to your Lead Market credit points (CPs). Please note that, if you do not buy average of 5 leads per month for consecutive 6 months, this additional benefit will be forfeited. Please note that you can continue to utilize main balance without any restrictions subjected to monthly maintenance expenses.
By downloading and using the Lead Market App you are agreeing to be bound by the following terms and conditions. We may change these terms and conditions at any time. Your continued use of the App means that you accept any new or modified terms and conditions that we come up with. Please re-visit the `Terms of Use' link from time to time to stay abreast of any changes that we may introduce.
The term ‘Lead Market’ is used throughout this entire Terms of Use document to refer to the App, its owners and the employees and associates of the owner.
1. REGISTRATION
By registering, you certify that all information you provide, now or in the future, is accurate to the best of your knowledge.
Lead Market reserves the right, in its sole discretion, to deny you access to Lead Market or any portion thereof without notice for the following reasons.
(a) any unauthorized access or use by you
(b) if you assign or transfer (or attempt the same) any rights granted to you under this Agreement;
(c) if you violate any of the other terms and conditions of this User Agreement.

2. LICENSE
Lead Market, hereby grants you a limited, non-exclusive, non-assignable and non-transferable license to access Lead Market provided and expressly conditioned upon your agreement that all such access and use shall be governed by all of the terms and conditions set forth in this USER AGREEMENT.
3. MONTHLY MAINTENANCE CHARGES
We incur huge expenses towards maintaining inventory of leads in the Lead Market app. Besides this, we incur expenses in disseminating this information to you through sms and notification along with software maintenance. In the event when our associates do not purchase leads which are highly perishable in nature from the lead market we incur huge losses. Hence we charge a nominal fees of 50 Credits per month towards maintenance ONLY if you are not buying a minimum of 5 PAID leads. This will increase to Rs 100 per month if you continue not to buy leads for 2 consecutive months. Company reserves the right to increase or decrease this price at its sole discretion.
4. FREE LEADS
You are eligible to claim a FREE Lead for every Paid Lead bought during the last 30 days subject to availability , which means if you have bought 10 Paid leads in the last 30 days, you can claim upto 10 FREE leads. However, you can't buy more than the daily quota allowed based on your LeadMarket wallet balance as defined in FREE Lead section under LeadMarket.
5. COPYRIGHT & NO RETRANSMISSION OF INFORMATION
Lead Market App as well as the design and information contained in Lead Market is the valuable, exclusive property of Suvision Holdings Private Limited, and nothing in this Agreement shall be construed as transferring or assigning any such ownership rights to you or any other person or entity. All stock call information on Lead Market is the proprietary, confidential property of Lead Market and cannot be repeated for any reason outside the Lead Market. You agree not to repeat or rebroadcast in any way any of the stock call information made on Lead Market for any reason whatsoever. You agree that if you do repeat or re-post any of Lead Market calls by any means, you will be liable for actual and punitive damages as determined by Lead Market and additional damages to be determined by an Indian court of Law.
You may not resell, redistribute, broadcast or transfer the information or use the information in a searchable, machine-readable database unless separately and specifically authorized in writing by Lead Market prior to such use. You may not rent, lease, sublicense, distribute, transfer, copy, reproduce, publicly display, publish, adapt, store or time-share Lead Market, any part thereof, or any of the information received or accessed there from to or through any other person or entity unless separately and specifically authorized in writing by Lead Market prior to such use. In addition, you may not remove, alter or obscure any copyright, legal or proprietary notices in or on any portions of Lead Market without prior written authorization except as set forth herein, any other use of the information contained in Lead Market requires the prior written consent of Lead Market (Suvision Holdings Private Limited) and may require a separate fee.
6. DELAYS IN SERVICES
Neither Lead Market (including its and their directors, employees, affiliates, agents, representatives or sub -contractors) shall be liable for any loss or liability resulting, directly or indirectly, from delays or interruptions due to electronic or mechanical equipment failures, telephone interconnect problems, defects, weather, strikes, walkouts, fire, acts of God, riots, armed conflicts, acts of war, or other like causes. Lead Market shall have no responsibility to provide you access to the App while interruption of Lead Market is due to any such cause.
7. LIABILITY DISCLAIMER
You expressly agree that use of the app is at your sole risk. The contents, information, software, products, features and services published on this app may include inaccuracies or typographical errors. Changes are periodically added to the contents herein. Lead market and/or its respective suppliers may make improvements and/or changes in this app at any time. This app may be temporarily unavailable from time to time due to required maintenance, telecommunications interruptions, or other disruptions. Lead market (and its owners, suppliers, consultants, advertisers, affiliates, partners, employees or any other associated entities, all collectively referred to as associated entities hereafter) shall not be liable to user or member or any third party should lead market exercise its right to modify or discontinue any or all of the contents, information, software, products, features and services published on lead market.
Lead market and/or its respective associated entities make no representations about the suitability of the contents, information, software, products, features and services contained on this app for any purpose. All such contents, information, software, products, features and services are provided "as is" without warranty of any kind. Lead market and/or its associated entities hereby disclaim all warranties and conditions with regard to these contents, information, software, products, features and services, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title, non-infringement, and availability.
In no event shall lead market and/or its associated entities be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with the use of this app or with the delay or inability to use lead market, or for any contents, information, software, products, features and services obtained through lead market, or otherwise arising out of the use of lead market, whether based on contract, tort, strict liability or otherwise, even if lead market or any of its associated entities has been advised of the possibility of damages.
We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any transaction, on account of the card holder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time".
8. USE OF APP AS A COMMUNICATION MEANS
If this App contains message, boards, chat rooms, calling or other message or communication facilities (collectively, "Fora"), you agree to use them only to send and receive messages and material that are proper and related to the particular Forum. By way of example, and not as a limitation, you agree that when using a Forum, you shall not do any of the following:
a) Defame abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
b) Publish post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information.
c) Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights there to or have received all necessary consents
d) Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
e) Conduct or forward surveys, contests, or chain letters.
f) Download any file posted by another user of a Forum that you know, or reasonably should know, cannot be legally distributed in such manner.
9. EQUIPMENT AND OPERATION
You shall provide and maintain all telephone/internet and other equipment necessary to access Lead Market, and the costs of any such equipment and/or telephone/internet connections or use, including any applicable taxes, shall be borne solely by you. You are responsible for operating your own equipment used to access Lead Market.
10. INFORMATION DISCLAIMER
You acknowledge that the information provided through Lead Market is compiled from sources, which are beyond the control of Lead Market though such information is recognized by the parties to be generally reliable, the parties acknowledge that inaccuracies may occur and Lead Market does not warrant the accuracy or suitability of the information. For this reason, as well as the possibility of human and mechanical errors and other factors,you acknowledge that lead market is provided to you on an "as is, with all faults" basis. Lead market expressly disclaims any and all warranties, whether express, oral, implied, statutory or otherwise, of any kind to the users and/or any third party, including any implied warranties of accuracy, timeliness, completeness, merchantability and fitness for a particular purpose, as well as any warranties arising by virtue of custom of trade or course of dealing and any implied warranties of title or non-infringement. In addition, lead market, in providing the information makes no endorsement of any particular security, martket participant, or brokerage. Further, lead market does not represent or warrant that it will meet your requirements or is suitable for your needs.
Under this User Agreement, you assume all risk of errors and/or omissions in Lead Market, including the transmission or translation of information. You assume full responsibility for implementing sufficient procedures and checks to satisfy your requirements for the accuracy and suitability of Lead Market, including the lead information, and for maintaining any means, which you may require for the reconstruction of lost data or subsequent manipulations or analyses of the information under the User Agreement.
You agree that lead market (including its and their officers, directors, employees, affiliates, group companies agents, representatives or subcontractors) shall not in any event be liable for any special, incidental or consequential damages arising out of the use or inability to use lead market for any purpose whatsoever. Lead market and it's affiliates, officers, directors, employees and agents shall have no liability in tort, contract, or otherwise to user and/or any third party.
11. LINKS TO THIRD PARTY SITES
The links or Advertisement in Lead Market App will allow you to leave the App. Lead Market has not reviewed such links or advertisements. The linked sites are not under the control of these sites and is not responsible for the contents or omissions of any linked site or any links contained in a linked site. The inclusion of any linked site does not imply endorsement by Lead Market of the site. Third party links/advertisements to Lead Market shall be governed by a separate agreement.
12. INDEMNIFICATION
You shall indemnify, defend and hold harmless lead market (including its and their officers, directors, employees, affiliates, group companies, agents, representatives or subcontractors) from any and all claims and losses imposed on, incurred by or asserted as a result of or related to:
(a) your access and use of Lead Market
(b) any non-compliance by user with the terms and conditions hereof; or
(c) any third party actions related to users receipt and use of the information, whether authorized or unauthorized.
Any clause declared invalid shall be deemed severable and not affect the validity or enforceability of the remainder. These terms may only be amended in a writing signed by Lead Market.
13. CONFLICTING TERMS
If there is any conflict between this User Agreement and other documents, this User Agreement shall govern, whether such order or other documents is prior to or subsequent to this User Agreement, or is signed or acknowledged by any director, officer, employee, representative or agent of Lead Market.
14. ATTORNEY'S FEES
If Lead Market (Suvision Holdings Private Limited) takes action (by itself or through its associate companies) to enforce any of the provisions of this User Agreement, including collection of any amounts due hereunder, Lead Market (Suvision Holdings Private Limited) shall be entitled to recover from you (and you agree to pay), in addition to all sums to which it is entitled or any other relief, at law or in equity, reasonable and necessary attorney's fees and any costs of any litigation.
15. ENTIRE AGREEMENT
This User Agreement constitutes the entire agreement between the parties, and no other agreement, written or oral, exists between you and Lead Market. By using the Information on Lead Market, you assume full responsibility for any and all gains and losses, financial, emotional or otherwise, experienced, suffered or incurred by you. Lead Market does not guarantee the accuracy, completeness or timeliness of, or otherwise endorse in any way, the views, opinions or recommendations expressed in the Information, does not give investment advice, and does not advocate the purchase or sale of any security or investment by you or any other individual. The Information is not intended to provide tax, legal or investment advice, which you should obtain from your professional advisor prior to making any investment of the type discussed in the Information. The Information does not constitute a solicitation by the information providers, Lead Market or other of the purchase or sale of securities.
The service is provided "as is," without warranty of any kind, either express or implied, including without limitation, any warranty for information, data, services, uninterrupted access, or products provided through or in connection with the service. Specifically, lead market disclaims any and all warranties, including, but not limited to: (i) any warranties concerning the availability, accuracy, usefulness, or content of information, products or services; and (ii) any warranties of title, warranty of non-infringement, and warranties of merchantability or fitness for a particular purpose. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tort, negligence, or under any other cause of action.
Neither lead market nor any of its employees, agents, successors, assigns, affiliates, group companies or content or service providers shall be liable to you or other third party for any direct, indirect, incidental, special or consequential damages arising out of use of service or inability to gain access to or use the service or out of any breach of any warranty. Because some countries do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. In such countries, the respective liability of lead market , its employees, agents, successors, assigns, affiliates, group companies and content or service providers respective liability is limited to the amount provided under said law. Further, you agree and understand that all services provided are non-refundable and that you should carefully consider whether our services are able to meet your needs.
16. TERMINATION
This User Agreement and the license rights granted hereunder shall remain in full force and effect unless terminated or cancelled for any of the following reasons:
(a) for any unauthorized access or use by you
(b) if you assign or transfer (or attempt the same) any rights granted to you under this Agreement;
(c) if you violate any of the other terms and conditions of this User Agreement.
Termination or cancellation of this Agreement shall not affect any right or relief to which Lead Market may be entitled, at law or in equity. Upon termination of this User Agreement, all rights granted to you will terminate and revert to Lead Market. Except as set forth herein, regardless of the reason for cancellation or termination of this User Agreement, the fee charged if any for access to Lead Market is non-refundable for any reason.
17. ARBITRATION
a. Each parties will first use their best endeavours to resolve through mutual consultation any dispute, difference or question arising between them or their respective representatives or assigns which may arise out of, in connection with or in relation to this Lead Market/Agreement/MOU/Contract/Business.
b. In the event of failure to resolve any dispute through mutual discussions as mentioned in clause (a) above, then such dispute or difference on this agreement shall be referred to the Arbitration of a sole Arbitrator to be appointed mutually by both the parties. The award of arbitration shall be final and binding on the parties. The Arbitration proceedings shall take place exclusively at Bangalore and shall be governed by the Arbitration and Conciliation Act, 1996 and the rules appended thereto or any statutory modification or amendment thereof for the time being in force and this arbitration shall be held in English Language. Each party shall bear its own cost of Arbitration.
18. JURISDICTION
The terms of this agreement are exclusively based on and subject to Indian law. You hereby consent to the exclusive jurisdiction and venue of courts in Bangalore in India in all disputes arising out of or relating to the use of Lead Market. Use of Lead Market is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.
19. FOR ASSOCIATES
If you are an Associate of Lead Market / IndianMoney.com, we would like to confirm that the following terms and conditions apply to you,
1) We do not Guarantee any conversion guarantee of leads served to you, it completely depends on you and customers acceptance of your service.
2) We will provide you with replacement of Lead only in the following 2 Situations –
a) If the customer is not contactable for any reason.
b) If the customer says that he has not given his consent to IndianMoney.com to transfer his request to you.
3) Lead accepted for replacement, then the price of the lead will be credited back to your My Wallet.
4) SMS, Email and App notifications are just the complimentary services and the non-delivery of the same is not the responsibility of Lead Market
5) You must login to your Lead Market App after delivery of every new lead, so as to help our system understand that you are properly utilizing our services. Further, this will also help our system deliver leads to your account regularly. Also you can view the lead details by checking the My Leads Page.
We are doing business as per the Associate Offer Document, therefore we request the Associate/user who is buying leads from us through the Lead Market App to abide by the rules and regulations formulated in the Associate Offer Document.
20. Location Services
It is a complementary service offered by Lead Market and it is in Beta stage (testing phase) and hence we can expect some error.
Do's to make best use of it:
a) Associates should have enabled GPS/Location all the time. It will take the recently updated pin code if you turn off it while travelling. Ex: If you have enabled your GPS/Location services in your smartphone at pin code 560027 and say you turn off there. Then if you move to say 560041 then our app will consider 560027 pin code itself to calculate the distance.
b) It is based on the pin code as conveyed by the Lead (consumer) over the phone call.
c) It is in beta stage (testing stage) and it is approximation.
